You have a point but I guess there isn't any perfect policy and if they sell it at the pre order price to the customers that ordered from them a few months ago regardless of the current price, I am sure there will be people complain about it as well.

I still think what they are doing is quite fair already.  Their policy is whichever is lower (pre order price vs current price), they will honor and let the pre order customer enjoy the lower price and of course price can flutuate according to market current price.
